Terms of Service
Overview
This website is operated by Maya’s Copper Singapore. Throughout the site, the terms “we”, “us”, and “our” refer to Maya’s Copper Singapore.
We make this website, including the information, products, tools, and services available through it, available to you subject to your acceptance of these Terms of Service and the other policies and notices published on the website.
By visiting our website and/or purchasing a product from us, you use our “Service” and agree to be bound by these Terms of Service, our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.
These Terms apply to all users of the website, including visitors, customers, suppliers, merchants, service providers, and content providers.
Please read these Terms carefully before using the website. Accessing or using the website constitutes acceptance of these Terms. If you do not agree with these Terms, you should not use the website or the services offered through it.
Any new services, features, or tools added to the website will also be subject to these Terms.
Nothing in these Terms limits or excludes consumer rights that cannot lawfully be restricted or excluded under applicable law.
Section 1 – Terms of Website Use
By using this website, you represent that you are of the legal age required in your place of residence to enter into a binding agreement.
Minors may use the website or place an order only with the consent of a parent or legal guardian where such consent is required by applicable law.
You must not use the website, our products, or our services:
- For any unlawful purpose;
- To violate any law or regulation;
- To infringe copyright or other rights;
- To distribute viruses, malicious code, or harmful software;
- To attempt to gain unauthorized access to the website or systems connected to it.
A material breach of these Terms may result in restricted access or termination of the Service.
Section 2 – General Conditions
We may refuse an order or restrict use of the Service where there is a legitimate reason to do so, including suspected fraud, misuse, violation of law, payment issues, or security risks.
Information you provide may be transmitted across different networks and systems as necessary to operate the website and process your order. Sensitive payment information is transmitted using generally accepted security and encryption measures.
You may not copy, reproduce, sell, distribute, or commercially exploit any part of the website or Service without our prior written permission.
Section headings are provided for convenience only and do not affect the interpretation of these Terms.
Section 3 – Accuracy and Completeness of Information
We make reasonable efforts to ensure that information on the website is accurate, complete, and current. However, errors, inaccuracies, or outdated information may occasionally occur.
General information on the website does not constitute professional advice and should not be relied upon as the sole basis for making an important decision.
We may update, change, or remove content from the website. Where applicable law requires us to update particular information, we will comply with that obligation.
Section 4 – Prices and Changes to the Service
Product prices may change from time to time. The price applicable to an order is the price displayed and confirmed during checkout, subject to correction of an obvious error.
Any applicable taxes, shipping charges, or mandatory fees will be displayed or included in the price where required by applicable law.
We may modify, suspend, or discontinue part of the website or Service, subject to existing obligations and customer rights under applicable law.
Formation of Contract
Displaying products on the website constitutes an invitation to place an order and does not necessarily constitute a binding offer.
Submitting an order constitutes an offer by the customer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not prevent us from cancelling it due to payment issues, lack of stock, suspected fraud, shipping restrictions, or an obvious error.
If we cancel an order after payment has been collected, we will refund the amount paid using the original payment method.
Product Rights
Products remain subject to any mandatory rights relating to quality, conformity, repair, replacement, or other remedies available under applicable law.
Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded.
Section 5 – Products and Services
Certain products may be available exclusively through the website and may be available in limited quantities.
Returns, refunds, and cancellations will be handled in accordance with our Returns & Refunds Policy and applicable law.
We make reasonable efforts to display product colours, sizes, materials, and characteristics accurately. However, appearance may vary depending on your screen and device settings.
Products made from copper or other natural materials may have slight variations in colour, texture, and appearance. Natural changes in the colour or patina of copper are not necessarily a defect.
We may restrict the sale or delivery of products to certain locations where legal, logistical, security, or operational restrictions apply.
International Fulfilment
Maya’s Copper Singapore works with international logistics and fulfilment partners. Depending on stock availability, orders may be dispatched from different fulfilment centres around the world.
Items from the same order may occasionally be shipped in separate packages and arrive at different times.
Applicable taxes, duties, or clearance charges will be displayed before purchase where we are required to collect them or can reasonably calculate them in advance.
Where a government authority, customs authority, or courier lawfully charges an amount directly to the recipient, we will provide relevant information where reasonably possible.
Section 6 – Medical Information and Product Use
Information on the website relating to copper, magnets, comfort, support, or general wellness is provided for informational purposes only.
Our products are not medicines and are not substitutes for professional medical advice, diagnosis, or treatment unless a specific product is expressly and lawfully marketed as a medical device.
We do not guarantee any particular medical or therapeutic result.
If you have a metal allergy, use an implanted medical device, are pregnant, are receiving medical treatment, or experience irritation, pain, or an unusual reaction, you should discontinue use and consult an appropriate healthcare professional.
Section 7 – Order and Billing Information
We may refuse, limit, or cancel an order where there is a legitimate reason, including:
- Suspected fraud or unauthorized use of a payment method;
- An obvious pricing or product-information error;
- Lack of stock;
- Shipping restrictions;
- Incorrect or incomplete information;
- A material violation of these Terms.
You agree to provide complete and accurate purchase, contact, billing, and shipping information.
If you discover an error in your order details, please contact us as soon as possible at support@mayascopper.com.
It may not always be possible to change an order once processing or fulfilment has begun.
Section 8 – Payment
Available payment methods will be displayed during checkout.
The payment provider may carry out security, verification, or fraud-prevention checks in accordance with its own terms and privacy practices.
By submitting a payment, you represent that you are authorized to use the selected payment method.
Section 9 – Shipping and Delivery
The estimated total delivery time to Singapore is 5-8 business days from the date the order is placed. This period will generally include approximately 1–3 business days for order processing.
The stated delivery period is a reasonable estimate and is not an absolute guarantee.
Public holidays, high order volumes, customs procedures, weather conditions, transportation disruptions, supplier delays, courier delays, or other circumstances outside our reasonable control may affect delivery times.
Further information is available in our Shipping Policy.
Any rights you may have under applicable law in relation to delayed or failed delivery remain unaffected.
Section 10 – Third-Party Tools and Services
We may provide access to tools or services supplied by third parties, including Shopify, payment providers, couriers, tracking services, and advertising platforms.
Your use of those tools or services may also be subject to the third party’s own terms and policies.
Nothing in this section limits our responsibility to customers where applicable law places that responsibility on us.
Section 11 – Links to External Websites
The website may contain links to third-party websites or services.
We do not control the content, security, or privacy practices of external websites and are not responsible for them except where applicable law provides otherwise.
We recommend reviewing the terms and privacy policies of any external website before making a purchase or providing personal information.
Section 12 – Comments, Reviews, and User Content
When you voluntarily provide us with a comment, review, photograph, video, or other content, you grant us permission to use that content for operating, promoting, and marketing the website, within the scope of the rights you have provided and subject to applicable law.
You must not submit content that:
- Is unlawful, abusive, offensive, or misleading;
- Infringes copyright, trademark, privacy, or other rights;
- Contains another person’s personal information without permission;
- Contains viruses or malicious code;
- Impersonates another person.
We may remove content that violates these Terms or applicable law.
We do not guarantee that every review, comment, or submission will be published.
Section 13 – Personal Information and Privacy
Processing of personal information is governed by our Privacy Policy.
We use information necessary to operate the website, process payments, fulfil orders, deliver products, provide customer service, maintain security, and carry out the other activities described in our Privacy Policy.
Failure to provide information necessary to complete an order or provide a particular service may prevent us from fulfilling the order or providing that service.
Section 14 – Errors and Inaccuracies
The website may occasionally contain errors or omissions relating to product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.
We may correct obvious errors and update information.
If a correction materially affects an order that has already been placed, we will notify the customer and provide any remedy required under applicable law.
Section 15 – Prohibited Uses
You must not use the website or its content for:
- Unlawful activity;
- Violation of any law, regulation, or lawful order;
- Infringement of intellectual property rights;
- Harassment, threats, defamation, or unlawful discrimination;
- Providing false or misleading information;
- Uploading viruses or malicious code;
- Unauthorized collection of personal information;
- Spam, phishing, or impersonation;
- Interfering with website security;
- Circumventing protective measures;
- Interfering with the normal operation of the Service.
We may restrict or terminate access in the event of a violation.
Section 16 – Cancellations, Returns, and Refunds
Cancellations, returns, and refunds will be handled in accordance with our Returns & Refunds Policy and applicable Singapore consumer law.
In addition to any mandatory rights available under applicable law, we offer a voluntary return period of 30 days from the date you receive the product, subject to the conditions in our Returns & Refunds Policy.
For voluntary change-of-mind returns, the customer may be responsible for return shipping costs as described in our Returns & Refunds Policy.
Where a product is defective, incorrect, damaged, or does not conform to the order, any rights or remedies available under applicable Singapore law remain unaffected.
We will not impose charges that are prohibited by applicable law.
Section 17 – Limitation of Liability
We make reasonable efforts to provide a safe and properly functioning website and Service, but we do not guarantee that the website will be continuously available or completely free from errors or interruptions.
Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.
To the extent permitted by applicable law, we will not be responsible for indirect or unforeseeable loss that does not result from a breach of a legal obligation owed by us.
Any limitation or exclusion of liability in these Terms applies only to the extent that it is lawful and reasonable under applicable law.
Singapore’s Unfair Contract Terms Act contains restrictions on excluding or limiting certain liabilities and applies a reasonableness test to particular contractual terms. AGC
Section 18 – Indemnification
To the extent permitted by applicable law, you agree to indemnify Maya’s Copper Singapore against losses or expenses resulting from your unlawful use of the website, intentional breach of these Terms, or infringement of a third party’s rights.
This section does not impose liability on a consumer where such liability is not permitted by applicable law and does not limit mandatory consumer rights.
Section 19 – Force Majeure
We will not be responsible for delays or failure to perform caused by circumstances outside our reasonable control, including:
- War or civil disturbance;
- Government actions or restrictions;
- Natural disasters;
- Strikes;
- Communications or systems failures;
- Epidemics or pandemics;
- Major transport disruptions;
- Unusual customs delays.
Where such circumstances occur, we will take reasonable steps to reduce the impact and keep affected customers informed where appropriate.
Any rights that cannot lawfully be limited remain unaffected.
Section 20 – Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
The invalid provision will be interpreted or limited only to the extent necessary to make it lawful and enforceable where possible.
Section 21 – Termination of Use
These Terms apply for as long as you use the website or Service.
You may stop using the website at any time.
We may restrict or terminate access where there is a material breach, unlawful use, fraud, or a security risk.
Provisions that by their nature are intended to continue after termination will remain in effect.
Section 22 – Entire Agreement
These Terms of Service, together with the policies referred to in them, constitute the applicable agreement governing use of the website and purchases made through it.
Failure to enforce a particular right on one occasion does not constitute a waiver of that right in the future.
Section 23 – Governing Law and Dispute Resolution
These Terms and transactions with customers in Singapore are governed by the laws of Singapore, subject to any mandatory consumer protections that apply to the customer.
Nothing in these Terms is intended to avoid protections that would otherwise apply to a consumer under Singapore law. Singapore’s Unfair Contract Terms Act specifically contains provisions addressing choice-of-law clauses involving consumers habitually resident in Singapore. AGC
If you have a question, concern, or complaint, we encourage you to contact us first at support@mayascopper.com so that we can try to resolve the matter directly.
Nothing in this section prevents a consumer from contacting an appropriate authority, dispute-resolution body, or court where they are entitled to do so.
Section 24 – Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business operations, or applicable legal requirements.
The version applicable to an order is the version in effect when the order was placed.
Material changes will be published on the website and will take effect from the date stated in the updated Terms.
Continued use of the website after updated Terms take effect constitutes acceptance of the revised version to the extent permitted by applicable law.
